POPIA Notice

1. Responsible Party

Afrika Cargo Flow Logistics (Pty) Ltd, with registered address at Cape Town & Johannesburg, South Africa, is the Responsible Party for personal information processed via this platform.

3. Conditions for Lawful Processing

We process personal information in accordance with the eight conditions of POPIA:

2. Processing limitation, only what is adequate, relevant, and not excessive.
3. Purpose specification, collected for explicit, defined purposes.
4. Further processing limitation, only for compatible purposes.
5. Information quality, kept complete, accurate, and updated.
6. Openness, published in this notice and our Privacy Policy.
7. Security safeguards, technical and organisational measures applied.
8. Data subject participation, you can access, correct, and delete your data.

4. Categories of Personal Information

See Privacy Policy § 2 for the full list. Special personal information (e.g. biometric or financial data) is only processed where authorised by Section 27 of POPIA, typically for FICA / KYC compliance.

5. Section 18 Notification

When we collect your personal information directly from you, we inform you of:

• The information being collected.
• The purpose for which it is collected.
• Whether collection is voluntary or mandatory.
• Consequences of failure to provide the information.
• Any law authorising or requiring collection.
• Recipients of the information.
• Whether information will be transferred outside South Africa, and to which countries.
• Your rights of access, correction, objection, and complaint.

6. Cross-Border Transfers (Section 72)

Personal information may be transferred outside South Africa for cross-border freight execution. We only transfer to recipients in countries with similar data protection laws, or where binding corporate rules / contractual safeguards equivalent to POPIA are in place.

7. Your Rights as a Data Subject (Sections 23 to 25)

• Right to be notified of personal information collection.
• Right of access to your personal information (Section 23).
• Right to request correction or deletion (Section 24).
• Right to object to processing (Section 11(3)).
• Right to object to direct marketing (Section 69).
• Right to lodge a complaint with the Information Regulator.
